What is the UDRP?

The Uniform Domain Name Dispute Resolution Policy (UDRP) is an administrative process for certain trademark-based disputes over domain-name registrations. It applies to domains registered under gTLDs through ICANN-accredited registrars and to some country-code domains whose registries have adopted it.

A complainant must prove all three elements: the disputed domain name is identical or confusingly similar to a mark in which the complainant has rights; the respondent has no rights or legitimate interests in the domain; and the domain was registered and is being used in bad faith.

The UDRP does not award trademark damages or general injunctive relief. Its remedies are transfer or cancellation. The strength of the complaint therefore depends on matching the facts and evidence to those three elements rather than treating the proceeding as a conventional trademark lawsuit.
