Can a UDRP be filed when WHOIS is private or the registrant is hidden?

Yes. Privacy or proxy services and redacted registration data do not by themselves prevent a UDRP filing. The provider obtains registrar verification, and the disclosed registration information may require the complainant to amend the complaint or otherwise address the underlying registrant.

The important procedural point is to distinguish the privacy or proxy service from the underlying registrant once the registrar provides verified information and to follow the provider’s amendment or notification procedures.

Privacy can also be one fact in a broader bad-faith analysis, but it should not be treated as proof of wrongdoing by itself. The key is to distinguish ordinary privacy usage from false identities, cyberflight, or other evidence relevant to the actual case.
